Mhsh Themes License Agreement

This License Agreement ("License") governs the use of Astro themes ("Themes") purchased from Mhsh Themes ("Licensor"). By purchasing, downloading, or using any Theme, you ("Licensee") agree to be bound by the terms of this License. If you have any questions, please contact mhsh.in-themes@yahoo.com.

General

Licensor grants Licensee an ongoing, non-exclusive, worldwide license to use the Themes for specific purposes under the conditions outlined below. This License applies to individuals, companies, businesses, or organizations using the Themes for personal or commercial projects.

License Terms

Permissions

• Use the Theme to create unlimited End Products for yourself or your clients. An "End Product" is a website, web application, or other digital project built using the Theme.
• Modify the Theme (e.g., code, design, assets) to create derivative versions, which remain subject to this License.
• Use the Theme for personal or commercial End Products, including websites or web applications that are sold, licensed, sublicensed, or freely distributed.
• Create open-source End Products that are freely available to end users.

Restrictions

• You cannot:
  • Redistribute the Theme or its derivatives as a standalone product or as part of another product (e.g., in theme marketplaces, stock sites, or public repositories).
  • Use the Theme to create End Products designed to allow end users to build their own websites or applications using the Theme or its derivatives (e.g., website builders or template editors).
  • Convert the Theme to another framework (e.g., React, Vue) and distribute it, whether for sale or for free.
  • Use the Theme or its derivatives to train AI models.
  • Use the Theme to create End Products that are the property of any individual or entity other than the Licensee or their clients.

Usage Examples

Allowed by the License

• Creating a personal portfolio website or a website for your company.
• Building a website or web application for a client, where the client owns the End Product.
• Developing a commercial SaaS application where end users pay a fee to use it.
• Creating a commercial self-hosted web application sold to end users for a one-time fee.
• Building an open-source web application where the Theme’s components are not redistributed separately.

Not Allowed by the License

• Publishing a repository of Theme components or templates publicly.
• Converting the Theme to another framework (e.g., React, Vue) and distributing it, whether for sale or for free.
• Creating a website builder where end users can assemble websites using the Theme’s components or derivatives.
• Building an admin panel tool or template using the Theme and distributing it, whether for sale or for free.
• Using the Theme in a website builder service, even if the resulting websites are hosted as subdomains and cannot operate independently.
• Using the Theme or its components to train AI models.

Additional Terms

• Attribution: You are not required to attribute or link to Mhsh Themes in your projects, though attribution is appreciated (e.g., “Theme by Mhsh Themes” with a link to https://themes.mhsh.in).
• Third-Party Assets: Some Themes may include third-party assets (e.g., fonts, images) licensed under their respective terms. Licensee is responsible for complying with these licenses, as outlined in the Theme’s documentation. Example: Google Fonts used in the Theme are licensed under the SIL Open Font License.
• Ownership: The copyright and intellectual property rights of the Themes are owned by Mhsh Themes. Licensee is granted only the permissions described in this License; all other rights are reserved.
• Updates and Support: Licensor may provide updates or support at its discretion, as outlined at the time of purchase. Support is limited to Theme functionality and does not include customization or third-party integration.

Warranty Disclaimer

The Themes are provided “as is,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Licensor does not guarantee that the Themes will be error-free, secure, or compatible with all systems.

Limitation of Liability

Licensor’s liability for costs, damages, or losses arising from Licensee’s use of the Themes, including third-party claims, is limited to a refund of the license fee. Licensor is not liable for any consequential damages related to the use of the Themes.

Termination

This License is effective until terminated. Licensor may terminate the License if Licensee breaches any of its terms. Upon termination, Licensee must cease using the Theme and destroy all copies in their possession.
